1. Acceptance & Binding Agreement

By accessing, browsing, registering for, or using MyCourtDocs ("Platform"), you ("User," "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and our Legal Disclaimer — collectively, the "Agreement." If you do not agree to every provision of this Agreement, you must immediately cease all use of the Platform.

Your continued use of the Platform after any modification to these Terms constitutes your binding acceptance of those modifications. We may amend these Terms at any time without prior notice.

2. Not a Legal Service — Complete Disclaimer

MyCourtDocs is exclusively a software documentation and organizational tool. MyCourtDocs is NOT a law firm, legal service, legal advisor, legal information service, court filing service, or legal technology provider offering legal guidance of any kind.

NOTHING on the Platform — including but not limited to text, features, AI-generated outputs, organizational tools, templates, exports, summaries, suggestions, labels, categories, scoring, pattern detection, factor mapping, or any other functionality — constitutes legal advice, legal representation, a legal opinion, a legal recommendation, or any form of legal guidance.

No attorney-client relationship, fiduciary relationship, or professional relationship of any kind is created between you and MyCourtDocs by your use of the Platform.

3. Complete Waiver & Release of Claims

BY USING THE PLATFORM, YOU VOLUNTARILY, KNOWINGLY, AND IRREVOCABLY WAIVE, RELEASE, AND FOREVER DISCHARGE MYCOURTDOCS, LLC, ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, SUITS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS' FEES) OF EVERY KIND AND NATURE, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF THE PLATFORM.

This waiver and release includes, without limitation, claims arising from:

• Any adverse outcome in any legal proceeding, court hearing, mediation, arbitration, or dispute
• Loss of custody, visitation, parental rights, or any modification thereof
• Reliance on any feature, output, content, suggestion, or functionality of the Platform
• Inaccuracy, incompleteness, or unreliability of any AI-generated or automated content
• Inadmissibility or rejection of any record, export, or document created through the Platform
• Loss, corruption, unauthorized access, or breach of data
• Platform downtime, errors, bugs, or interruptions
• Any action, inaction, or decision made based on information from the Platform
• Emotional distress, financial loss, or any other harm of any nature

YOU EXPRESSLY WAIVE ANY RIGHTS UNDER ANY STATUTE OR LEGAL DOCTRINE THAT WOULD OTHERWISE LIMIT THE SCOPE OF THIS RELEASE TO INCLUDE ONLY THOSE CLAIMS KNOWN OR SUSPECTED TO EXIST AT THE TIME OF AGREEING TO THESE TERMS.

4. Assumption of All Risk

You expressly acknowledge, agree, and accept that:

• You are using the Platform entirely at your own risk and of your own free will
• You assume all risk — including but not limited to legal, financial, emotional, and personal risk — associated with the use of the Platform and any content you create, store, export, or share
• You are solely responsible for the accuracy, completeness, truthfulness, and legality of all information you enter
• You are solely responsible for how you use any records, exports, outputs, or content in legal proceedings or otherwise
• MyCourtDocs has no control over, responsibility for, and accepts no liability for the outcome of any legal proceeding, dispute, hearing, or matter of any kind
• You will obtain and rely on the advice of a licensed attorney in your jurisdiction for all legal matters
• The Platform may contain errors, omissions, or inaccuracies, and you assume all risk of relying on any Platform output

5. License

We grant you a limited, non-exclusive, non-transferable, revocable, terminable license to use the Platform for personal documentation purposes only. We may revoke this license at any time, for any reason or no reason, with or without notice.

6. Account

You are responsible for maintaining the security of your credentials and for all activity under your account. You must be at least 18 years old. You represent that all information you provide is accurate.

7. Your Content

You retain ownership of content you enter. You grant us a perpetual, worldwide, royalty-free license to store, process, and use your content to operate and improve the Platform. We are not responsible for verifying, validating, reviewing, or ensuring the accuracy, legality, admissibility, or suitability of your content for any purpose.

8. AI & Automated Features

The Platform may include AI-powered and automated features. ALL AI AND AUTOMATED OUTPUTS ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY WHATSOEVER. Outputs may be inaccurate, incomplete, misleading, or entirely wrong. You are solely responsible for reviewing, verifying, and independently confirming any output before any use. MyCourtDocs disclaims all liability for any reliance on automated outputs.

9. Payment & Refunds

Access requires a paid subscription. All fees are non-refundable. We may change pricing at any time. You authorize recurring charges to your payment method.

10. Termination

We may suspend or terminate your access at any time, for any reason or no reason, with or without notice, and without any liability to you. Upon termination, your license ends immediately. We may delete your data at any time following termination. We have no obligation to retain, return, export, or provide copies of your data.

11. Disclaimer of All Warranties

THE PLATFORM IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS
• WARRANTIES THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED
• WARRANTIES THAT ANY CONTENT WILL BE ADMISSIBLE, EFFECTIVE, OR USEFUL IN ANY LEGAL PROCEEDING
• WARRANTIES THAT ANY RESULTS OBTAINED WILL BE ACCURATE, RELIABLE, OR BENEFICIAL
• ANY IMPLIED WARRANTY ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASED PARTIES SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER — INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO US IN THE THIRTY (30) DAYS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to fully indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, suits, proceedings, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to: (a) your use of the Platform; (b) your content; (c) your violation of these Terms; (d) your use of any Platform output in any proceeding; (e) any third-party claim related to your use of the Platform; (f) your violation of any law, regulation, or court order; or (g) any allegation that your use of the Platform caused harm to any person or entity.

14. Covenant Not to Sue

You covenant and agree that you will not institute, prosecute, or maintain any lawsuit, action, claim, or proceeding of any kind against any of the Released Parties arising from or related to your use of the Platform. If you breach this covenant, you agree to pay all costs, expenses, and attorneys' fees incurred by the Released Parties in defending against such action, regardless of the outcome.

15. Mandatory Binding Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION administered by the American Arbitration Association under its Commercial Arbitration Rules, in Denton County, Texas. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY FORM OF REPRESENTATIVE OR CONSOLIDATED PROCEEDING.

You agree that any arbitration shall be conducted on an individual basis only. The arbitrator may not consolidate proceedings or preside over any form of representative or class proceeding.

16. Governing Law & Venue

These Terms are governed exclusively by the laws of the State of Texas, without regard to conflict of law provisions. To the extent any matter is not subject to arbitration, exclusive jurisdiction lies with the state or federal courts in Denton County, Texas, and you consent to personal jurisdiction therein.

17. Severability

If any provision is found unenforceable, it shall be enforced to the maximum extent permissible, and the remaining provisions remain in full force. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

18. Entire Agreement

This Agreement constitutes the entire agreement between you and MyCourtDocs and supersedes all prior or contemporaneous agreements, representations, and understandings, whether oral or written.
